Treasure Data AI Acceptable Use Policy

  1. SCOPE

This AI Acceptable Use Policy (“AI AUP”) is incorporated by reference to Treasure Data’s AI Terms and applies to Customer’s use of AI Services. All capitalized terms not defined herein shall have the meaning ascribed to them in the AI Terms or applicable Service Agreement.

  1. USAGE RESTRICTIONS

Customer and its Users must not use AI Services for the following:

    1. Automated decision-making with legal or similar effects (e.g., determining the eligibility of a consumer to purchase a financial product or the cost of an insurance product for a consumer), unless Customer ensures that the final decision is made by a qualified person reviewing the Output and taking into considerations factors beyond any Output or recommendation obtained through the use of the AI Services;
    1. Unlawfully profiling individuals on the basis of lawfully protected characteristics or predicting lawfully protected characteristics (including without limitations racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, sex life or sexual orientation, health status, pregnancy status, disabilities, criminal convictions or likelihood to commit a crime);
    1. Generating individualized advice that in the ordinary course of business would be provided by a licensed professional (such as medical, financial or legal advice);
    1. Generating or distributing political campaign materials to the public or targeting individuals with it;
    1. Using Input consisting of images or videos to assist in identifying a person or to solicit or infer private or sensitive information about a person; or to reproduce the likeness of any person without express consent and all necessary rights, or to reproduce the likeness of anyone under legal age;
    1. Any purpose that is deemed as “high risk” or that is not permitted under the EU Artificial Intelligence Act 2024;
    1. Operation of critical infrastructure; any use that could result in the death or serious bodily injury of any person, or in environmental or other catastrophic damage, including through warfare; or any activity that is overseen by, or requires clearance or approval from, a regulatory authority; or
    1. Engaging in or encouraging any activity that is illegal, fraudulent or deceptive (including but not limited to misrepresenting content generated through automated means as human generated) or that violates the rights of others.
  1. AI SERVICE PROVIDER-SPECIFIC TERMS

Some AI Services rely on the use of third party large language models or foundational models. Depending on the AI Service Provider used to process Customer Content, Customer’s use of such AI Services must also comply with the following terms and policies, as may be modified by the AI Service Provider from time to time:

  1. CHANGES TO THIS AI AUP

Treasure Data may change this AI AUP by posting an updated version of it at https://www.treasuredata.com/terms/ai-acceptable-use-policy. Updates to Section 3 of this AI AUP (“AI Service Provider-Specific Terms”) or updates otherwise required by applicable law will be effective upon publication. Any other update to this AI AUP will be effective 30 days after its publication. A Customer’s violation of this AI AUP will be considered a material breach of the Service Agreement.
